A federal court ruled that the government cannot enforce certain NFA registration requirements against the parties covered by that case. It is not a repeal of the NFA, it is not nationwide, and it does not change state law.

Tennessee: state law does not tie suppressor possession to federal NFA registration. The federal questions still apply, including what happens the first time you cross into one of the fifteen states that do.

Ownership Requirements

To own a suppressor in Tennessee, you must meet federal requirements:

  • Be 21 years or older to purchase from a dealer (a trustee on a trust can be 18 or older)
  • Be a U.S. citizen or legal permanent resident
  • Be legally allowed to possess firearms
  • Complete ATF Form 4 with fingerprints and photograph
  • Pass FBI background check

Tennessee does not impose additional state requirements beyond federal law.

Hunting Regulations

Hunting with a suppressor is legal in Tennessee, and state law or the state wildlife agency says so expressly.

TWRA states that the use of suppressors is legal for persons possessing the required federal license. The regulations reference the Department of Treasury, which is an anachronism since ATF moved to DOJ in 2003, but the substance is NFA compliance.

What State Law Actually Says

Tennessee repealed its silencer ban outright. The Tennessee Hearing Protection Act, 2017 Public Chapter 339, effective July 1, 2017, deleted the definition of “firearm silencer” from T.C.A. § 39-17-1301 and the prohibited-weapon entry from § 39-17-1302(a)(5).

The General Assembly’s own summary: the act “deletes the prohibition on possession, manufacture, transport, repair, or sale of a firearm silencer.”

Local Rules and Preemption

T.C.A. § 39-17-1314(a) preempts “the whole field of the regulation of firearms, ammunition, or components” to the exclusion of every local government. Tenn. Const. art. I, § 26 secures the right subject to legislative regulation of the wearing of arms.

Worth Knowing

The Tennessee Firearms Freedom Act, T.C.A. ch. 4-54, expressly names “flash or sound suppressors” as covered accessories and declares Tennessee-made, Tennessee-kept items outside federal regulation. No Tennessee court has ruled on it, and the Ninth Circuit rejected Montana’s materially identical act in 2013.
