A federal court ruled that the government cannot enforce certain NFA registration requirements against the parties covered by that case. It is not a repeal of the NFA, it is not nationwide, and it does not change state law.

Missouri: state law does not tie suppressor possession to federal NFA registration. The federal questions still apply, including what happens the first time you cross into one of the fifteen states that do.

Ownership Requirements

To own a suppressor in Missouri, you must meet federal requirements:

  • Be 21 years or older to purchase from a dealer (a trustee on a trust can be 18 or older)
  • Be a U.S. citizen or legal permanent resident
  • Be legally allowed to possess firearms
  • Complete ATF Form 4 with fingerprints and photograph
  • Pass FBI background check

Missouri does not impose additional state requirements beyond federal law.

Hunting Regulations

Hunting with a suppressor is legal in Missouri. No Missouri statute and no state wildlife agency regulation restricts suppressor use while hunting.

Read that precisely. This is legality by the absence of a prohibition, not an express permission. Some states say in so many words that you may hunt with a suppressor. Missouri does not say anything at all. That is the ordinary situation and it is not cause for alarm, but it does mean an agency could add a rule without the legislature acting, so the current regulations guide is the thing to check, not this page.

What State Law Actually Says

RSMo § 571.020.1(6)(c) makes it an offense to knowingly possess, manufacture, transport, repair or sell “[a]ny of the following in violation of federal law … (c) A firearm silencer.” A class D felony.

The federal condition is part of the offense element itself, so lawful NFA possession is simply not an offense. Note that the separate conformity defense at § 571.020.2 covers subdivisions (1) to (5) and does not reach subdivision (6). It does not need to.

Local Rules and Preemption

RSMo § 21.750.1 occupies “the entire field of legislation touching in any way firearms, components, ammunition and supplies.” Mo. Const. art. I, § 23, amended in 2014, extends to “ammunition, and accessories typical to the normal function of such arms” and applies strict scrutiny.

Worth Knowing

Missouri’s Second Amendment Preservation Act is unenforceable. The United States sued, and the Eighth Circuit affirmed the judgment striking it in 2024: “a State cannot invalidate federal law to itself.” The sections remain printed in the Revised Statutes but have no effect.
