A federal court ruled that the government cannot enforce certain NFA registration requirements against the parties covered by that case. It is not a repeal of the NFA, it is not nationwide, and it does not change state law.

Kentucky: state law does not tie suppressor possession to federal NFA registration. The federal questions still apply, including what happens the first time you cross into one of the fifteen states that do.

Ownership Requirements

To own a suppressor in Kentucky, you must meet federal requirements:

  • Be 21 years or older to purchase from a dealer (a trustee on a trust can be 18 or older)
  • Be a U.S. citizen or legal permanent resident
  • Be legally allowed to possess firearms
  • Complete ATF Form 4 with fingerprints and photograph
  • Pass FBI background check

Kentucky does not impose additional state requirements beyond federal law.

Hunting Regulations

Hunting with a suppressor is legal in Kentucky, and state law or the state wildlife agency says so expressly.

The KDFWR Hunting and Trapping Guide states that hunters with a federal permit for a firearm suppressor may use it to hunt legal game animals, including coyotes, squirrels, deer, elk and bears, with a valid hunting license. No KRS chapter 150 or 301 KAR provision addresses silencers, so the agency guide is the operative published authority.

What State Law Actually Says

Kentucky bans nothing. Neither KRS chapter 237 (Firearms and Destructive Devices) nor chapter 527 (Offenses Relating to Firearms and Weapons) contains a silencer offense.

Local Rules and Preemption

KRS 65.870(1) bars every city, county and local agency from occupying “any part of the field of regulation” of firearms, components or firearms accessories. Ky. Const. § 1, Seventh secures the right to bear arms subject to concealed-carry regulation.

Worth Knowing

Kentucky has a CLEO shall-sign statute, and it names the sheriff specifically. KRS 237.075(2)(a) requires certification within 15 days where the applicant is not prohibited, and § 237.075(1)(b) designates “the sheriff of the county of the applicant’s residence, notwithstanding the provisions of 27 C.F.R. secs. 479.63 and 479.85.” Denials are appealable to Circuit Court.
