A federal court ruled that the government cannot enforce certain NFA registration requirements against the parties covered by that case. It is not a repeal of the NFA, it is not nationwide, and it does not change state law.

  • Be a U.S. citizen or legal permanent resident
  • Be legally allowed to possess firearms
  • Complete ATF Form 4 with fingerprints and photograph

What State Law Actually Says

Maryland imposes no ban and no state permit. The only statutory mention is a sentencing provision: Md. Code, Crim. Law § 5-621(d) defines “firearm silencer” and then doubles the mandatory minimum where a firearm used in a drug trafficking crime is equipped with one.

Local Rules and Preemption

Maryland preemption is partial, not total. Crim. Law § 4-209(a) preempts local regulation of handguns, rifles, shotguns and their ammunition and components, but § 4-209(b)(1) preserves local authority over minors and “within 100 yards of or in a park, church, school, public building, and other place of public assembly.”

Maryland has no state constitutional right to keep and bear arms. The Declaration of Rights contains only a militia clause at Article 28.
