A federal court ruled that the government cannot enforce certain NFA registration requirements against the parties covered by that case. It is not a repeal of the NFA, it is not nationwide, and it does not change state law.

Texas: state law does not tie suppressor possession to federal NFA registration. The federal questions still apply, including what happens the first time you cross into one of the fifteen states that do.

Ownership Requirements

To own a suppressor in Texas, you must meet federal requirements:

  • Be 21 years or older to purchase from a dealer (a trustee on a trust can be 18 or older)
  • Be a U.S. citizen or legal permanent resident
  • Be legally allowed to possess firearms
  • Complete ATF Form 4 with fingerprints and photograph
  • Pass FBI background check

Texas does not impose additional state requirements beyond federal law.

Hunting Regulations

Hunting with a suppressor is legal in Texas, and state law or the state wildlife agency says so expressly.

The TPWD Outdoor Annual states that suppressors “may be used to take any wildlife resource; however, all federal, state and local laws continue to apply.” No species limit and no season limit.

What State Law Actually Says

Texas has no suppressor offense at all. HB 957 (2021) struck “a firearm silencer” from the Penal Code § 46.05(a) prohibited weapons list, repealed the definition at § 46.01(4), and dismissed pending prosecutions outright.

The same act created Government Code ch. 2, whose § 2.052 declares that a Texas-made suppressor that stays in Texas “is not subject to federal law or federal regulation, including registration.”

Local Rules and Preemption

Tex. Local Gov’t Code § 229.001(a)(1) bars a municipality from regulating “the transfer, private ownership, keeping, transportation, licensing, or registration of firearms” or components. Tex. Const. art. I, § 23 secures the right subject to regulation of the wearing of arms to prevent crime.

Worth Knowing

Be careful what you read about HB 957. No court has given § 2.052 effect against the NFA. In Paxton v. Dettelbach (5th Cir. 2024) the court affirmed judgment for the federal government on standing, and described § 2.052 as an attempt to immunize Texas citizens from federal law rather than a regulation of conduct. Making or possessing an unregistered suppressor remains a federal felony regardless of where it was built.
