August 5 NFA Ruling

A federal court ruled that the government cannot enforce certain NFA registration requirements against the parties covered by that case. It is not a repeal of the NFA, it is not nationwide, and it does not change state law.

Ownership Requirements

To own a suppressor in New Hampshire, you must meet federal requirements:

  • Be 21 years or older to purchase from a dealer (a trustee on a trust can be 18 or older)
  • Be a U.S. citizen or legal permanent resident
  • Be legally allowed to possess firearms
  • Complete ATF Form 4 with fingerprints and photograph
  • Pass FBI background check

Local Rules and Preemption

RSA 159:26, I gives the State authority over “the sale, purchase, ownership, use, possession, transportation, licensing, permitting, taxation, or other matter pertaining to firearms, firearms components” to the exclusion of local regulation. N.H. Const. pt. I, art. 2-a: “All persons have the right to keep and bear arms in defense of themselves, their families, their property and the state.”

Worth Knowing

New Hampshire’s 2022 enforcement ban, RSA ch. 159-E, contains a sentence that matters here: “Silence in the New Hampshire Revised Statutes Annotated pertaining to a matter regulated by federal law shall be construed as an inconsistency for the purposes of this chapter.” Since state law is now silent on suppressors, that clause is squarely in play.
